US SUPREME COURT OVERTURNS IOWA HEROIN OVERDOSE DEATH CONVICTION

01/28/2014

The U.S. Supreme Court on Monday overturned the conviction of an Iowa drug dealer who received a 20-year prison sentence for selling heroin to a man who later overdosed.

At issue in the case was whether Marcus Burrage, 27, could be found guilty for causing the overdose death of Joshua Banka, 32, when the heroin he sold Banka only contributed to the overdose. The court’s ruling means federal prosecutors will face a higher burden of proof in holding drug dealers accountable when their customers overdose.
